Plant Breeder’s Rights
Plant breeder’s rights (PBR) – administered under Australia’s Plant Breeder’s Rights Act 1994 , through the Plant Breeder’s Rights Office at IP Australia – provides certain rights in a plant variety.
PBR in a plant variety is the exclusive right to do, or to license another person to do, the following acts in relation to propagating material of the plant variety:
- Produce or reproduce plant material;
- Condition the material for the purpose of propagation;
- Offer the material for sale;
- Sell the material;
- Import the material;
- Expert the material;
- Stock the material for the purposes described above.
