This Webinar will address issues arising on claim construction and whether it is ever impermissible to construe in light of alleged infringements. Reference will be made to the circumstances in the Globaltech/Australian Mud Company litigation. In that case, Globaltech (infringer) was called upon for an oral hearing of its special leave application to the High Court on 20 March 2020. The issues arising in the special leave application will be discussed by reference to the decisions at trial and in the Full Court.
