Plant Breeder’s Rights

Plant breeder’s rights (PBR) – administered under Australia’s Plant Breeder’s Rights Act 1994, through the Plant Breeder’s Rights Office at IP Australia – provides certain rights in a plant variety.

PBR in a plant variety is the exclusive right to do, or to license another person to do, the following acts in relation to propagating material of the plant variety:

  • Produce or reproduce plant material;
  • Condition the material for the purpose of propagation;
  • Offer the material for sale;
  • Sell the material;
  • Import the material;
  • Expert the material;
  • Stock the material for the purposes described above.
